2. PURPOSE

These General Terms and Conditions govern the commercial relationship between Kosmetica.es and the user/customer when placing an order through the online store www.kosmetica.es.

Kosmetica.es sells natural and vegan cosmetic products imported from South Korea.

3. PURCHASE PROCESS

The purchase process follows these steps:

1. The user selects the desired products and adds them to the shopping cart.
2. In the cart, the user can review products, quantities, and prices.
3. The user proceeds to checkout, entering shipping and billing details.
4. The user selects the shipping method and payment method.
5. Before confirming the order, a summary is displayed with the full breakdown (products, shipping costs, taxes, and total).
6. The user confirms the order by clicking the purchase button, which implies acceptance of these General Terms and Conditions.
7. A confirmation email is sent with all order details.

4. PRICES

All prices shown in the store are expressed in euros (€) and include applicable VAT. Shipping costs are not included in the product price and are displayed before completing the purchase.

Kosmetica.es reserves the right to modify prices at any time. Products will be invoiced at the price in effect at the time of order confirmation.

5. PAYMENT METHODS

Kosmetica.es offers the following payment methods:

• Credit/debit card (Visa, Mastercard)
• Revolut Pay
• Apple Pay
• Google Pay
• Klarna (deferred payment)
• Bank transfer (available for certain customer groups)

Payments are securely processed through the Stripe payment gateway, which complies with PCI-DSS security standards.

6. SHIPPING AND DELIVERY TIMES

Orders are shipped via Correos España. Estimated delivery times are:

• Standard shipping (mainland Spain): 2-3 business days from payment confirmation.
• Direct delivery (available areas): 1 business day.

These timeframes are estimates and may be affected by circumstances beyond Kosmetica.es''s control. In no case shall the delivery period exceed 30 days from order confirmation, unless the customer is expressly informed.

7. RIGHT OF WITHDRAWAL

In accordance with Articles 102 to 108 of Royal Legislative Decree 1/2007 (Spanish Consumer Protection Law), the customer has the right to withdraw from the contract within 14 calendar days without providing any reason and without penalty.

The withdrawal period expires 14 calendar days from the day the customer, or a third party indicated by the customer (other than the carrier), physically receives the goods.

7.1 How to exercise the right of withdrawal

To exercise the right of withdrawal, the customer must notify their decision by an unequivocal statement, which may be made:

• By email to: [email protected]
• Using the withdrawal form we provide, although its use is not mandatory.

To meet the withdrawal deadline, it is sufficient that the communication is sent before the period expires.

7.2 Effects of withdrawal

In case of withdrawal, Kosmetica.es will reimburse all payments received from the customer, including delivery costs (except additional costs arising from the customer''s choice of a delivery method other than the least expensive standard delivery offered), without undue delay and in any event within 14 calendar days from the date of notification of withdrawal.

The refund will be made using the same means of payment used by the customer for the initial transaction, unless expressly agreed otherwise.

The customer must return the products without undue delay and in any event within 14 calendar days of communicating withdrawal. The customer shall bear the direct cost of returning the goods.

7.3 Exceptions to the right of withdrawal

In accordance with Article 103 of the Spanish Consumer Protection Law, the right of withdrawal shall not apply to:

• Sealed products which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery (Art. 103.e). This includes cosmetics whose safety seal has been opened.

Important: If the product is returned with its original seal intact, the right of withdrawal shall apply in full.

8. RETURNS FOR DEFECTIVE OR INCORRECT PRODUCTS

If the product received is defective, expired, does not match the order, or has been damaged during transport, the customer must contact us within 7 days of receipt by sending an email to [email protected] with photographs and a description of the issue.

In these cases, Kosmetica.es will cover the return costs and will, at the customer''s choice, replace the product or provide a full refund.

9. LEGAL WARRANTY

All products sold by Kosmetica.es are covered by the 3-year legal conformity warranty established by Royal Decree-Law 7/2021, transposing EU Directives. If the product does not conform to the contract, the customer may request repair, replacement, price reduction, or contract termination as provided by law.

10. LIABILITY

Kosmetica.es is not responsible for improper use of products. Customers must follow the manufacturer''s usage instructions and precautions as indicated on product labeling.

All products sold comply with European cosmetics regulations (EC Regulation 1223/2009) and are imported in compliance with all EU Responsible Person obligations.

11. ONLINE DISPUTE RESOLUTION

In accordance with EU Regulation 524/2013, we inform consumers that the European online dispute resolution (ODR) platform is available for out-of-court resolution of disputes arising from online sales contracts:

12. APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions are governed by Spanish law. For the resolution of any dispute, the parties shall submit to the Courts and Tribunals of the consumer''s domicile, in accordance with applicable legislation.

If the customer is not a consumer, the parties shall submit to the Courts and Tribunals of Valencia.

13. MODIFICATIONS

Kosmetica.es reserves the right to modify these conditions. Modifications shall take effect upon publication on the website and shall not affect orders placed prior to publication.
